5 Real Estate Contract Terms You Should Actually Understand

Real estate contracts can look intimidating, but you don’t need a law degree to protect yourself. If you understand a few key terms, you’ll avoid surprises, protect your money, and feel way more confident before signing anything.

1. Contingencies
These are your safety nets. Things like inspections, financing, and appraisals have to check out before the deal is final. If they don’t, you can renegotiate or walk away without losing your earnest money. Removing contingencies can make an offer stronger, but it also increases risk.

2. Earnest Money
This is the buyer’s good-faith deposit, usually 1–3% of the price. If the deal falls apart for a valid reason, the buyer gets it back. Walk away without cause? The seller may keep it.

3. Price & Financing Terms
This spells out the price, loan type, deadlines, and how the buyer is paying. Miss a deadline and the deal can fall apart fast. Pre-approval matters more than most people think.

4. Closing Date & Possession
Closing is when ownership transfers. Possession is when the buyer actually gets the keys. Those two are not always the same, and mixing them up causes major stress.

5. Repairs & Credits
After inspections, this is where negotiations happen. Repairs, credits, price reductions — or nothing at all. Focus on big issues, not cosmetic stuff.

Contracts don’t have to be scary when you understand the basics. A good agent will guide you through every clause, but knowing what you’re signing puts you in control — and that’s where you want to be.
